These Terms of Service ("Terms") govern your access to and use of our escrow platform, which facilitates secure transactions between buyers and sellers. By using our Service, you agree to be bound by these Terms.


1. Overview of Service

CT National Escrow provides an online escrow service that acts as a neutral third party to hold funds during a transaction between a buyer and a seller. Our role is limited to holding and disbursing funds according to these Terms and the specific transaction terms agreed upon by the parties.

We are not a bank, money transmitter (except as licensed), or financial advisor. We do not guarantee the quality, safety, or legality of items or services transacted through our platform.


2. Eligibility

To use our Service, you must be at least 18 years old and capable of forming a legally binding contract in your jurisdiction. By registering, you represent that all information you provide is accurate and complete. We reserve the right to refuse service to anyone for any reason.


3. Account Registration and Security

You must create an account to use our Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized access. CT National Escrow is not liable for losses arising from unauthorized use of your account.


4. How Escrow Transactions Work

4.1 Transaction Initiation. Either party may initiate a transaction by providing details including the transaction amount, description of goods or services, and the other party's information. Both parties must agree to the transaction terms before funds are collected.

4.2 Funding. The buyer deposits funds into our escrow account. We accept payment methods as displayed on our platform. Funds are held until release conditions are met.

4.3 Inspection Period. Upon confirmation of delivery or service completion, the buyer has an inspection period (as specified in the transaction terms) to accept or dispute the transaction.

4.4 Release of Funds. If the buyer accepts or the inspection period expires without dispute, funds are released to the seller, minus applicable fees. If a dispute is raised, funds remain in escrow pending resolution.

4.5 Cancellation. Transactions may only be cancelled by mutual agreement of both parties or as otherwise provided in these Terms. Cancellation fees may apply.


5. Fees

Our fee schedule is published on our website and may be updated from time to time. Fees are typically paid by the buyer, seller, or split between parties as agreed. Fees are non-refundable except where required by law or at our discretion.


6. Disputes

6.1 Dispute Process. If a buyer is dissatisfied with a transaction, they may initiate a dispute during the inspection period. Both parties will be asked to provide documentation supporting their position.

6.2 Resolution. CT National Escrow will review submitted evidence and make a determination at our sole discretion. Our decision is final and binding on both parties with respect to the release of escrowed funds. This does not preclude either party from pursuing legal remedies independently.

6.3 Limitations. We are not an arbiter of the underlying transaction. Our role is limited to determining whether to release or return escrowed funds based on the evidence provided.


7. Prohibited Uses

You may not use our Service for any illegal activity, money laundering, fraud, transactions involving prohibited items (including but not limited to weapons, controlled substances, counterfeit goods, or stolen property), or any purpose that violates applicable law or these Terms. CT National Escrow reserves the right to report suspicious activity to law enforcement and to freeze or forfeit funds involved in prohibited transactions.


8. Identity Verification

We may require identity verification documents at any time to comply with anti-money laundering laws and our internal policies. Failure to provide requested documentation may result in account suspension or termination and forfeiture of escrowed funds as permitted by law.


9. Intellectual Property

All content on our platform, including logos, text, graphics, and software, is the property of CT National Escrow or its licensors. You may not copy, modify, distribute, or create derivative works without our express written permission.


10. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information.


11. Limitation of Liability

To the maximum extent permitted by law, CT National Escrow is not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the fees you paid to us in the twelve months preceding the claim.


12. Indemnification

You agree to indemnify and hold harmless CT National Escrow, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.


13. Modifications

We may modify these Terms at any time by posting the revised version on our website. Changes take effect upon posting. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.


14. Termination

CT National Escrow may suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, we will handle any escrowed funds according to our policies and applicable law.


15. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Connecticut, United States. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Connecticut.


16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.


17. Entire Agreement

These Terms, together with our Privacy Policy and any transaction-specific terms, constitute the entire agreement between you and CT National Escrow regarding your use of the Service.
